What is VAT?

VAT was introduced to the UK in 1973 when the country joined the European Economic Community (The EEC).  All EEC members agreed to replace their indirect taxes with VAT - Value Added Tax - calculated as a percentage of goods and services. The money generated through VAT is returned to the government. Now, more than 130 countries have adopted VAT.


On 5th April 1974 a VAT reclaim scheme known as Section 35 VATA was introduced with the aim of encouraging private individuals to create new dwellings. Over time, this scheme has evolved into what we have today, VAT431. Also known as The DIY Scheme, VAT431 was introduced in 2009 to allow private individuals building new dwellings or conversions to reclaim VAT on their building materials and services.


Unfortunately, the scheme does not yet put private individuals on a level playing field with building developers. There is still a lot of additional costs that cannot be reclaimed under the scheme, but that are available to a building developer. HMRC often seeks reasons to refuse the claim, or to reduce the total refund once they have acknowledged that the claim is valid.


It is important that you provide HMRC with the correct documentation, otherwise your claim will be rejected. They are also unable to reimburse any VAT paid to the supplier at the incorrect rate. If you are in any doubt whether you are 5% or 0% rated to contractors, our team can help you review your planning. If you are unsure, it is good practice to present the contractor with your planning decision notice for their records.
